1. Description of Promotion

Welcome to the Daily Bonus promotion (the “Promotion”), where participants who place wagers totaling One Dollar ($1) or more on any Casino games during the Promotion Period (as defined below) will receive a mystery bonus (“Mystery Bonus”) for use on your TSG Account (as defined below), regardless of if their wager win(s) or lose(s).

The Promotion is sponsored by TSG Interactive US Services Limited (“TSG” or “Sponsor”).  The terms “you” or “your” mean the person to whom a Mystery Bonus is issued to upon satisfaction of the terms and conditions set forth in this Promotion.  Redemption of the Promotion is expressly conditioned upon acceptance of and compliance with all of these Promotion “Terms and Conditions”.  Promotion participants may be required to sign paperwork issued by the Sponsor.

2. Promotion Period

The Promotion will begin at 8:00 AM ET on August 1, 2023 and end at 11:59 PM ET on August 31, 2023 (each a “Promotion Day” and collectively the “Promotion Period”).

3. Eligibility

The Promotion is only open to individuals who are at least 21 years of age and are physically present in Michigan or Pennsylvania during the Promotion Period. If your social security number is associated with another TSG Account (as defined below) in Sponsor's database, you may only earn one Mystery Bonus in respect of all such TSG Accounts (as defined below) under this Promotion. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Mystery Bonus.

For purposes of this Promotion, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children and grandchildren and those living in the same household shall mean people who share the same residence at least three (3) months a year, whether legally related or not. A person cannot be an eligible participant or winner if such person is a person: (a) with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control (“OFAC”) of the Department of the Treasury (including those named on OFAC’s Specially Designated and Blocked Persons List) or under any statute or executive order; or (b) who is acting, directly or indirectly, for or on behalf of any such person. All federal, state, and local taxes are the responsibility of each Mystery Bonus/Grand Prize (as defined below) winner. Void outside of Michigan, Pennsylvania and New Jersey and where prohibited by law.

4. Entry Requirements

There are two (2) methods of entry into this Promotion (each, an “Entry”), as follows:

Wager Method: Account holders must log in during the Promotion Period and opt in in the Challenges section of their TSG Account (as defined below) to participate in the Promotion. After opting-in, place one or more real money wagers totaling at least One Dollar ($1) on any of Sponsor’s Casino games” during the Promotion Period (“Wager Requirement”). You may place either one single wager or multiple wagers in order to meet the Wager Requirement. 

Alternate Method of Entry: Alternatively, participants may enter this Promotion by completing the form found at the link below, printing it and mailing it to PokerStars #1096 2230 Route 70 W STE 2 Cherry Hill, NJ 08002 along with a picture of your driver’s license or proof of age. (Collectively, the “Entry Requirements”). There is a limit of one (1) Entry per Promotion Day regardless of entry method.

5. Claiming Promotion Offer

Upon satisfying any of the Entry Requirements on a given Promotion Day, you will receive a ‘Mystery Chest’ containing one (1) of the following bonuses or offers:

(Each, a “Mystery Bonus”). Each Mystery Bonus must be utilized within twenty-four (24) hours of issuance at which they the Mystery Bonus will automatically expire. 

In addition to the Mystery Bonus, all entrants have an opportunity to win a grand prize of $5,000 in cash (“Grand Prize”). Every day participants submit an Entry into the Promotion, they will receive an entry into the draw (“Drawing Entry”) for the chance to win the Grand Prize. The draw will take place on the 1^st September 2023 with the winner notified via the contact information they provided when they submitted their Entry.

Each Mystery Bonus and other prizes awarded in this Promotion will be credited to your TSG Account within seventy-two (72) hours of your satisfaction of the Entry Requirements and must be used within twenty-four (24) hours of issuance. Promotion reward recipients will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion reward received, regardless of whether the Promotion reward, in whole or in part, is used.

Prizes are non-transferable, with no equivalents or substitutions except at Sponsor’s sole and absolute discretion. All prize details not specified in these Official Rules will be determined in Sponsor’s sole and absolute discretion. Prize details and availability are subject to change and prize provider’s rules and restrictions, and in the event that Sponsor is unable to provide the winner with his or her prize(s), the Sponsor may elect to provide winners with the approximate value of such item in cash or award an alternate prize of comparable or greater value. All prizes are awarded “AS IS” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Prize winners will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the prizes they receive, regardless of whether they, in whole or in part, are used. The approximate retail value (“ARV”) of the prizes is based on available information provided to Sponsor and the value of any prize awarded to a winner may be reported for tax purposes as required by law. The winners may be required to provide Sponsor with a valid social security number before the prizes will be awarded for tax reporting purposes. An IRS Form 1099 may be issued in the name of winners, or if a minor in the jurisdiction in which s/he resides, in the name of his/her parent or legal guardian, for the actual value of the prize received. Unclaimed prize(s) will be forfeited. Prize(s), if legitimately claimed, will be awarded.  The Promotion Entities are not responsible for and will not replace any lost, mutilated or stolen prizes or any prize that is undeliverable or does not reach the winner because of an incorrect or changed address. If a winner does not accept or use the entire prize, the unaccepted or unused part of the prize will be forfeited and the Promotion Entities will have no further obligation with respect to that prize or portion of the prize. The Promotion Entities are not responsible for and winner will not receive the difference, in any, between the actual value of the prize(s) at the time of award and the stated ARV in these Official Rules or in any Promotion-related correspondence or material.

6. Registration Procedures

To qualify for the Promotion, eligible individuals must have an active FOX Bet, Stars Casino or PokerStars member account (“TSG Account”) and verify your identity in order to play on Stars Casino. Creating a TSG Account at www.foxbet.com is free. By submitting your information and creating a TSG Account, however, participants will be required to agree to the TSG Privacy Policy and Terms. If you do not agree to TSG’s Terms and Privacy Policy, you cannot create a TSG Account or participate in this Promotion.

7. Limitations on Participation

In addition to the eligibility requirements in Section 3, Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in any Promotion for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Promotion in good faith. This Promotion is void where prohibited by law.  Limit of one (1) Mystery Bonus/Drawing Entry per person per Promotion Day in connection with this Promotion.

8. Wagering Requirements

Any wager placed prior to opting-in to the Promotion or after the expiration of the Promotion Period will not count towards the Wager Requirement.  Separately, wagers placed using site credits or any bonus received from a separate Sponsor promotion will not count towards the Wager Requirement. 

The Mystery Bonus and or Drawing Entry are not transferable and cannot be substituted except in the Sponsor’s sole discretion.  Casino Site Credit may only be used for wagering on your TSG Account. Notwithstanding the foregoing, the Mystery Bonus may be converted to cash by earning 2 redemption points for every $1 in Casino Site Credit awarded on any of Sponsor’s table and slot casino games, excluding live dealer table games. Redemption points are earned based on the game type and amount wagered. 9. Order of Funds Used for Wagering

Casino Site Credit is used before deposited funds when wagering.

10. Eligible Games

All Casino games are eligible to earn a Mystery Bonus and Drawing Entry.

11. Restrictions on Withdrawal

The Mystery Bonus/Drawing Entry is non-withdrawable. See Section 8 for instructions on how to withdraw winnings from wagers placed using the Mystery Bonus. Any unused portion of the Mystery Bonus will be automatically withdrawn from your TSG Account within Twenty-Four (24) hours after being credited to your TSG Account. You may withdraw your deposited funds without penalty at any time.

12. Cancellation

Should you wish to cancel your participation in this Promotion at any time, please contact customer support at support@foxbet.com. Upon cancellation, you may withdraw any funds you have deposited into your account without restriction. However, any Mystery Bonus amount in your account may not be withdrawn.

14. Additional Terms

Administration:  The Sponsor expressly reserves the right to amend, suspend or terminate this Promotion at any time without prior notice or consent.  Administration of this Promotion is at the sole discretion of the Sponsor.  Sponsor reserves the right to restrict at any time any TSG Account holder from participating in this Promotion for any reason.  Any questions relating to eligibility, these Terms and Conditions or any other questions concerning this Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.  No groups, clubs, corporations, companies, partnerships, or organizations may participate in this Promotion or reproduce or distribute any portion of these Terms and Conditions to their members.

Release and Waiver of Liability:  By redeeming this Promotion, participants agree to release, defend, indemnify and hold harmless the Sponsor, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Mystery Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by the Sponsor’s own negligence.  The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Mystery Bonus.  In consideration of the Mystery Bonus, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Promotion, in any and all advertising, promotions and other publicity conducted by the Sponsor and its affiliates.

Governing Law:  All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of participants and the Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

Dispute Resolution:  The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in New York County, New York and any other court with jurisdiction over the parties.  In arbitration, there is no judge or jury and review is limited.  The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction.  The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS.  In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service.  If an in-person hearing is required, then it will take place in New York, New York.  The federal or state law that applies to these Terms and Conditions will also apply during the arbitration.  Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New York County, New York.  The Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing).  Either party may, notwithstanding this provision, bring qualifying claims in small claims court.

LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Miscellaneous:  No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided.  If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
